2.- OBJECT OF THE CONTRACT.


The object of the present contract is the combined trip offered for sale, according to the main characteristics and essential information that in a pre-contractual way, therefore prior to this act, the traveler and his companions, have received from the agency with its own annexes: A, B and C.

Said pre-contractual information is attached to this contract as Annex I duly signed by the parties, forming an inseparable part of the same.



3.- ADDITIONAL INFORMATION AND DOCUMENTATION IN ADDITION TO THE PRE-CONTRACTUAL INFORMATION RECEIVED.


3.1.- SPECIAL NEEDS OF THE TRAVELER ACCEPTED BY THE ORGANIZER.


3.2.- DOCUMENTATION CORRESPONDING TO: TICKETS, VOUCHERS AND INVOICE.


The traveler is informed by the agency of: transport schedules, check-in deadline, scheduled time of stopovers and connections, receiving from the same, in Annex II to this contract, duly signed by the parties and forming an inseparable part of it, all documentation for: Transportation tickets, vouchers, invoice and other complementary documentation necessary for the realization of the trip, knowing and accepting the contracting conditions of all travel services.


3.3.- CERTIFICATE OF FINANCIAL GUARANTEE OF THE AGENCY IN CASE OF INSOLVENCY AND REPATRIATION.


As Annex III to this contract duly signed by the parties and forming an inseparable part of the same, the traveler receives a certificate from the guarantor of the insolvency and repatriation insurance of the organizing and retail travel agencies, whose contact details are those that have been provided with the pre-contractual information.


3.4.- ASSISTANCE, ILLNESS AND CANCELLATION INSURANCE POLICY.


As Annex IV to this contract duly signed by the parties and forming an inseparable part of it, the traveler receives a copy of the insurance policy contracted, knowing and accepting its scope and coverage.


4.- ASSISTANCE TO THE TRAVELER AT DESTINATION AND/OR TRANSIT POINTS


The organizer and the retailer of the contracted trip are jointly and severally liable to the traveler for the correct fulfillment of the travel services included in the contract.

You may communicate at any time with the retailer travel agency as well as with the organizer travel agency and, if applicable, with the local representative of the organizer at the emergency telephone numbers and e-mail address provided to you.

The organizer and the retailer undertake to provide adequate and prompt assistance to the traveler in difficulty, especially in the event of unavoidable and extraordinary circumstances, by providing the information necessary to avail himself of health services, local authorities, consular assistance, helping him, if necessary, to find alternative travel arrangements.

The traveler is informed that both the organizer and the retailer may charge a reasonable surcharge for such assistance if the difficulty has been caused intentionally or by negligence.


5.- TRAVEL OR STAY OF A MINOR ABROAD UNACCOMPANIED BY A RELATIVE OR OTHER AUTHORIZED ADULT


If the trip or stay is intended for a minor, you acknowledge by signing this document that you have received from the agency the information that allows you to contact him/her, as well as those responsible for his/her stay “in situ” during the trip.


6.- INFORMATION ON INTERNAL PROCEDURE FOR HANDLING COMPLAINTS AND ALTERNATIVE DISPUTE RESOLUTION.Any suggestion or complaint should be made to the organizing and retail travel agencies simultaneously and at any time at the email addresses listed in the identification data.In relation to the mechanisms of alternative dispute resolution, in accordance with the provisions of Article 40 the law 7/2017 of November 2 we inform you that on the website: www.aecosan.mssi.gob.esCorresponding to the Spanish Agency for Consumer Affairs, Food Safety and Nutrition you can consult the details of the Arbitration Boards as well as complementary information to file a complaint or claim.In the following link you can consult the alternative dispute resolution entities accredited in accordance with the provisions of Regulation EC: 524/2013 of the European Parliament. https://ec.europa.eu/consumers/odr/main/?event=main.home2.show&lng=ES

7.- CONFIRMATION OF THE RESERVATION.


At the signing of this contract has been the confirmation of the reservation of the trip. However, the organizer reserves the right to cancel the trip if it does not cover the number of registered persons necessary for its realization and so you are notified within the deadlines indicated in the pre-contractual information.


8.- CONSEQUENCES OF THE SUBSEQUENT MODIFICATION OF THE TRIP CHARACTERISTICS.


As it has been made known to you in the pre-contractual information, if prior to the start of the trip the organizer finds it necessary to substantially modify some of the main characteristics of the travel services or cannot comply with the special requests composed and accepted or proposes to increase for any reason the price of the trip by more than 8%, you may, within a period not exceeding ___________.Accept the proposed change or terminate the contract without penalty.If you choose to terminate the travel contract you may accept a new substitute package if the organizer can propose it and it is of equivalent or superior quality, if it is of inferior quality you will be informed about the consequent reduction of the price that would take place.If, after receiving complete information regarding the modification, you do not notify your decision within the indicated period, it will be understood that you choose to terminate the contract without any penalty.


9.- CONSEQUENCES OF THE LACK OF CONFORMITY IN THE PROVISION OF SERVICES ONCE THE TRIP HAS BEGUN.


The traveler is obliged to inform the organizer or the retailer without undue delay, and therefore as soon as he becomes aware, taking into account the circumstances of each case, of any lack of conformity that he appreciates during the execution of a travel service included in the contract.Unless it is impossible or involves a disproportionate cost, the organizer or the retailer, as the case may be, undertakes to remedy the lack of conformity.When a lack of conformity substantially affects the execution of the trip in such a way that a very significant part of the planned services cannot be provided, they will offer suitable alternative formulas of equal or superior quality for the continuation of the trip or, if only an alternative of inferior quality is possible, they will apply an appropriate reduction in the price, provided that the lack of conformity has not been caused by them.If for a justified reason, not being attributable to you the cause that gave rise to the lack of conformity or to a third party outside the provision of contracted services or having arisen as a result of an unforeseeable, unavoidable or extraordinary cause, you may be entitled to an appropriate reduction in the price of the trip and compensation for damages that will be limited by the conditions of payment of compensation to the various providers of travel services included in the package that apply in international conventions binding the European Union. In its case the indemnity will be triple the total price of the trip.



10.-TERMINATION OF THE CONTRACT PRIOR TO THE START OF THE TRIP AT THE REQUEST OF THE TRAVELER.


The present contract is subject to special cancellation conditions which you know and accept as indicated in the pre-contractual information you may terminate the contract before the start of the trip by expressly notifying the organizer and retailer.

Upon receipt of this notification, you will be provided within a reasonable time, justification of your settlement for which you authorize from this moment the organizing agency and retailer to subtract from the amounts delivered and to be reimbursed the amount corresponding to the penalties, cancellation fees and management fees below: ________


11.-PRESCRIPTION OF CLAIMS.


The statute of limitations for actions arising from this contract for the traveler as provided in Article 169 of Royal Legislative Decree 1/2007 of November 16 is two years.



12.-APPLICABLE LAW AND JURISDICTION.


The present contract is subject to Spanish Law and, in all matters not foreseen herein, Book IV of the Royal Legislative Decree 1/2007, which approves the revised text of the General Law for the Defense of Consumers and Users, shall be especially applicable.

The corresponding parties, waiving the jurisdiction that corresponds or may correspond to them, submit to the jurisdiction and competence of the Courts and Tribunals of the city of INDICATE PREFERENTIAL CITY HEADQUARTERS OF THE ORGANIZER, OR RETAILER to settle any discrepancy related to this contract.
